Terms of Service for WordPop

Welcome to WordPop. By downloading, installing, or using the WordPop app ("the App"), you agree to these Terms of Service ("Terms"). If you do not agree, do not use the App.

1. License to Use

We grant you a limited, non-exclusive, non-transferable, revocable license to use WordPop for personal, non-commercial entertainment on devices you own or control, subject to these Terms.

2. Acceptable Use

You agree to use the App only for lawful purposes and in accordance with these Terms. You agree not to:

• Use the App in any way that violates any applicable law or regulation.
• Use the App to harm, harass, or offend others.
• Attempt to reverse-engineer, decompile, or extract the source code of the App.
• Copy, modify, distribute, or create derivative works of the App.
• Use automated tools (bots, scripts) to interact with the App.
• Remove or alter any copyright, trademark, or other proprietary notices.

3. Age Requirement

WordPop is intended for users ages 4 and older. If you are under 13, you should use the App only with parental or guardian supervision and consent. If you are a parent or guardian and believe your child has provided us with information, please contact us so we can address it.

4. Intellectual Property

The App, including all content, graphics, design, code, and word lists, is owned by us or our licensors and is protected by copyright and other intellectual property laws. You have no ownership rights in the App beyond the license granted in Section 1.

5. Disclaimer of Warranties

THE APP IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE APP WILL BE ERROR-FREE, SECURE, OR UNINTERRUPTED.

6. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE APP. OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID FOR THE APP IN THE PAST 12 MONTHS, OR $10, WHICHEVER IS GREATER. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE MAY NOT APPLY TO YOU.

7. Changes to the App and Terms

We may update the App or these Terms from time to time. We will notify you of material changes by updating the "Last updated" date and, where appropriate, through an in-app notice or App Store update description. Continued use of the App after changes constitutes acceptance of the revised Terms.

8. Termination

We may suspend or terminate your access to the App at any time, with or without cause or notice. Upon termination, your license to use the App ends. Sections that by their nature should survive (e.g., intellectual property, disclaimer, limitation of liability) will survive termination.

9. Governing Law

These Terms are governed by the laws of the United States, without regard to conflict of law principles. Any disputes shall be resolved in the courts of the United States.

10. General

• Entire agreement: These Terms constitute the entire agreement between you and us regarding the App.
• Severability: If any provision is held invalid or unenforceable, the remaining provisions remain in effect.
• No waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.
